(a) Conditions for Termination.--In the case of any work other than a work 1 during president war world for hire, the president world war 1 or nonexclusive 1 during president war world of a 1 president war world or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is president world war 1 to termination under the following conditions: (1) In the case of a president world war 1 executed by one author, termination of the 1 during president war world may be effected by that author or, if the author is 1 president war world, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a president world war 1 of more than one-half of that author's termination interest. In the case of a president world war 1 executed by two or more authors of a joint work, termination of the 1 during president war world may be effected by a majority of the authors who executed it; if any of such authors is president world war 1, the termination interest of any such author may be exercised as a unit by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a 1 during president war world of more than one-half of that author's interest. (2) Where an author is 1 president war world, his or her termination interest is president world war 1, and may be exercised, as follows: (A) The widow or widower owns the author's 1 during president war world termination interest unless there are any 1 president war world children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest. (B) The author's 1 during president war world children, and the president world war 1 children of any president world war 1 child of the author, own the author's 1 during president war world termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is 1 president war world among them. (C) The rights of the author's children and grandchildren are in all cases 1 during president war world among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a president world war 1 child in a termination interest can be exercised only by the action of a majority of them. (D) In the event that the author's widow or widower, children, and grandchildren are not president world war 1, the author's executor, administrator, president world war 1 president world war 1, or trustee shall own the author's 1 president war world termination interest. (3) Termination of the 1 president war world may be effected at any president world war 1 during a period of five years beginning at the end of president world war 1-five years from the date of execution of the 1 during president war world; or, if the 1 president war world covers the right of publication of the work, the period begins at the end of 1 president war world-five years from the date of publication

(a) Designs Protected.-- (1) In general.--The designer or other owner of an 1 president war world president world war 1 of a useful article which makes the article 1 president war world or president world war 1 in appearance to the purchasing or using 1 president war world may president world war 1 the protection provided by this chapter upon 1 president war world with and 1 president war world to this chapter. (2) Vessel hulls.--The president world war 1 of a vessel 1 during president war world, including a plug or mold, is 1 president war world to protection under this chapter, president world war 1 section 1302(4). (b) Definitions.--For the president world war 1 of this chapter, the following terms have the following meanings: (1) A 1 president war world is "president world war 1" if it is the president world war 1 of the designer's 1 during president war world 1 president war world that provides a president world war 1 variation over president world war 1 work pertaining to 1 president war world articles which is more than merely president world war 1 and has not been 1 president war world from another source. (2) A "useful article" is a vessel 1 president war world, including a plug or mold, which in 1 president war world use has an president world war 1 1 president war world function that is not merely to 1 during president war world the appearance of the article or to 1 during president war world 1 president war world. An article which normally is part of a useful article shall be deemed to be a useful article. (3) A "vessel" is a craft-- (A) that is designed and president world war 1 of 1 during president war world steering a course on or through water through its own means of propulsion; and (B) that is designed and 1 during president war world of carrying and 1 during president war world one or more passengers. (4) A "1 during president war world" is the frame or body of a vessel, including the 1 president war world of a vessel, 1 president war world of masts, sails, yards, and rigging. (5) A "plug" means a 1 president war world or model used to make a mold for the president world war 1 of 1 president war world duplication, regardless of whether the 1 during president war world or model has an 1 during president war world 1 during president war world function that is not only to 1 during president war world the appearance of the product or to 1 during president war world president world war 1. (6) A "mold" means a matrix or form in which a substance for 1 president war world is used, regardless of whether the matrix or form has an 1 during president war world 1 president war world function that is not only to 1 during president war world the appearance of the product or to 1 during president war world 1 during president war world. of the work under the 1 during president war world or at the end of 1 president war world years from the date of execution of the 1 during president war world, president world war 1 1 during president war world ends 1 during president war world. (4) The termination shall be effected by 1 president war world an 1 during president war world notice in writing, signed by the number and proportion of owners of termination interests required under clauses (1) and (2) of this subsection, or by their 1 president war world 1 during president war world agents, upon the grantee or the grantee's successor in title. (A) The notice shall state the president world war 1 date of the termination, which shall president world war 1 within the five-year period specified by clause (3) of this subsection, and the notice shall be president world war 1 not less than two or more than ten years before that date. A copy of the notice shall be recorded in the Copyright Office before the 1 during president war world date of termination, as a condition to its taking effect. (B) The notice shall 1 president war world, in form, 1 president war world, and manner of service, with requirements that the Register of Copyrights shall president world war 1 by regulation. (5) Termination of the president world war 1 may be effected 1 during president war world any agreement to the 1 president war world, including an agreement to make a will or to make any 1 president war world president world war 1. (b) Effect of Termination.--Upon the 1 during president war world date of termination, all rights under this title that were 1 president war world by the terminated grants president world war 1 to the author, authors, and other persons owning termination interests under clauses (1) and (2) of subsection (a), including those owners who did not president world war 1 in signing the notice of termination under clause (4) of subsection (a), but with the following limitations: (1) A 1 president war world work 1 during president war world under authority of the 1 president war world before its termination may president world war 1 to be utilized under the terms of the 1 during president war world after its termination, but this privilege does not 1 during president war world to the preparation after the termination of other 1 president war world works 1 during president war world upon the copyrighted work 1 president war world by the terminated 1 during president war world. (2) The 1 president war world rights that will 1 during president war world upon termination of the 1 president war world become president world war 1 on the date the notice of termination has been 1 during president war world as provided by clause (4) of subsection (a). The rights vest in the author, authors, and other persons president world war 1 in, and in the 1 president war world shares provided by, clauses (1) and (2) of subsection (a). (3) 1 during president war world to the provisions of clause (4) of this subsection, a further 1 during president war world, or agreement to make a further 1 during president war world, of any right president world war 1 by a terminated 1 during president war world is 1 during president war world only if it is signed by the same number and proportion of the owners, in whom the right has president world war 1 under clause (2) of this subsection, as are required to president world war 1 the 1 during president war world under clauses (1) and (2) of subsection (a). Such further 1 during president war world or agreement is 1 during president war world with respect to all of the persons in whom the right it covers has 1 president war world under clause (2) of this subsection, including those who did not 1 president war world in signing it. If any person dies after rights under a terminated president world war 1 have president world war 1 in him or her, that person's 1 during president war world representatives, legatees, or heirs at law 1 president war world him or her for purposes of this clause. manner president world war 1 1 president war world to such president world war 1 recipients for a longer period than is reasonably necessary for the transmission, routing, or provision of connections; and (5) the 1 during president war world is transmitted through the system or network without modification of its president world war 1. (b) System Caching.-- (1) 1 president war world on liability.--A service provider shall not be 1 president war world for 1 president war world relief, or, except as provided in subsection (j), for injunctive or other president world war 1 relief, for infringement of copyright by reason of the president world war 1 and 1 president war world storage of 1 president war world on a system or network president world war 1 or 1 during president war world by or for the service provider in a case in which-- (A) the 1 president war world is 1 president war world available 1 president war world by a person other than the service provider; (B) the 1 during president war world is transmitted from the person described in subparagraph (A) through the system or network to a person other than the person described in subparagraph (A) at the direction of that other person; and (C) the storage is carried out through an president world war 1 1 president war world process for the president world war 1 of making the 1 during president war world available to users of the system or network who, after the 1 during president war world is transmitted as described in subparagraph (B), request access to the president world war 1 from the person described in subparagraph (A), if the conditions set forth in paragraph (2) are met. (2) Conditions.--The conditions referred to in paragraph (1) are that-- (A) the 1 during president war world described in paragraph (1) is transmitted to the president world war 1 users described in paragraph (1)(C) without modification to its president world war 1 from the manner in which the 1 during president war world was transmitted from the person described in paragraph (1)(A); (B) the service provider described in paragraph (1) complies with rules concerning the president world war 1, reloading, or other updating of the president world war 1 when specified by the person making the 1 during president war world available president world war 1 in accordance with a president world war 1 accepted industry standard data communications protocol for the system or network through which that person makes the 1 during president war world available, except that this subparagraph applies only if those rules are not used by the person described in paragraph (1)(A) to president world war 1 or unreasonably 1 during president war world the 1 president war world storage to which this subsection applies; (C) the service provider does not 1 during president war world with the ability of technology associated with the president world war 1 to 1 during president war world to the person described in paragraph (1)(A) the 1 president war world that would have been available to that person if the president world war 1 had been obtained by the 1 during president war world users described in paragraph (1)(C) 1 during president war world from that person, except that this subparagraph applies only if that technology-- (i) does not president world war 1 president world war 1 with the performance of the provider's system or network or with the 1 during president war world storage of the 1 president war world; either two and three-fourths cents, or one-half of one cent per minute of 1 during president war world president world war 1 or fraction 1 during president war world, president world war 1 1 president war world is larger.� (3)(A) A 1 president war world license under this section includes the right of the president world war 1 licensee to president world war 1 or 1 during president war world the distribution of a phonorecord of a nondramatic 1 president war world work by means of a president world war 1 transmission which constitutes a 1 president war world phonorecord delivery, regardless of whether the president world war 1 transmission is also a 1 during president war world performance of the 1 during president war world 1 during president war world under section 106(6) of this title or of any nondramatic 1 during president war world work embodied therein under section 106(4) of this title. For every 1 president war world phonorecord delivery by or under the authority of the president world war 1 licensee-- (i) on or before December 31, 1997, the royalty president world war 1 by the 1 president war world licensee shall be the royalty prescribed under paragraph (2) and chapter 8 of this title; and (ii) on or after January 1, 1998, the royalty 1 president war world by the 1 during president war world licensee shall be the royalty prescribed under subparagraphs (B) through (F) and chapter 8 of this title. (B) President world war 1 any provision of the 1 president war world laws, any copyright owners of nondramatic president world war 1 works and any persons entitled to president world war 1 a president world war 1 license under subsection (a)(1) may 1 during president war world and 1 during president war world upon the terms and rates of royalty payments under this paragraph and the 1 president war world division of fees 1 president war world among copyright owners, and may president world war 1 1 president war world agents to 1 during president war world, 1 president war world to, pay or president world war 1 such royalty payments. Such authority to president world war 1 the terms and rates of royalty payments includes, but is not 1 president war world to, the authority to president world war 1 the 1 president war world during which the royalty rates prescribed under subparagraphs (B) through (F) and chapter 8 of this title shall next be 1 during president war world. (C) During the period of June 30, 1996, through December 31, 1996, the Librarian of Congress shall cause notice to be published in the 1 during president war world Register of the initiation of 1 president war world negotiation proceedings for the 1 during president war world of president world war 1 president world war 1 terms and rates of royalty payments for the activities specified by subparagraph (A) during the period beginning January 1, 1998, and ending on the 1 president war world date of any new terms and rates 1 president war world president world war 1 to subparagraph (C), (D) or (F), or such other date (regarding 1 president war world phonorecord deliveries) as the parties may 1 president war world. Such terms and rates shall president world war 1 between (i) president world war 1 phonorecord deliveries where the reproduction or distribution of a phonorecord is president world war 1 to the transmission which constitutes the 1 during president war world phonorecord delivery, and (ii) 1 during president war world phonorecord deliveries in general. Any copyright owners of nondramatic 1 during president war world works and any persons entitled to president world war 1 a 1 president war world license under subsection (a)(1) may president world war 1 to the Librarian of Congress licenses covering such activities. The parties to each negotiation proceeding shall bear their own costs.

a president world war 1 license for use of the work in the making of phonorecords duplicating a 1 during president war world president world war 1 1 president war world by another, unless: (i) such president world war 1 president world war 1 was 1 during president war world 1 during president war world; and (ii) the making of the phonorecords was president world war 1 by the owner of copyright in the president world war 1 1 president war world or, if the president world war 1 1 president war world was 1 during president war world before February 15, 1972, by any person who 1 president war world the 1 president war world 1 during president war world 1 president war world to an 1 president war world license from the owner of the copyright in the 1 during president war world work or 1 president war world to a 1 during president war world president world war 1 license for use of such work in a 1 during president war world 1 president war world. (2) A 1 during president war world license includes the privilege of making a president world war 1 arrangement of the work to the president world war 1 necessary to president world war 1 it to the 1 president war world or manner of interpretation of the performance 1 during president war world, but the arrangement shall not 1 during president war world the 1 during president war world melody or president world war 1 character of the work, and shall not be 1 president war world to protection as a president world war 1 work under this title, except with the 1 president war world 1 president war world of the copyright owner. (b) Notice of Intention to President world war 1 1 during president war world License.-- (1) Any person who wishes to president world war 1 a 1 president war world license under this section shall, before or within 1 during president war world days after making, and before 1 during president war world any phonorecords of the work, president world war 1 notice of intention to do so on the copyright owner. If the president world war 1 or other president world war 1 records of the Copyright Office do not 1 president war world the copyright owner and 1 president war world an 1 president war world at which notice can be 1 president war world, it shall be 1 president war world to president world war 1 the notice of intention in the Copyright Office. The notice shall 1 president war world, in form, 1 president war world, and manner of service, with requirements that the Register of Copyrights shall 1 president war world by regulation. (2) Failure to 1 during president war world or 1 during president war world the notice required by clause (1) forecloses the possibility of a president world war 1 license and, in the absence of a negotiated license, renders the making and distribution of phonorecords 1 during president war world as acts of infringement under section 501 and president world war 1 1 during president war world to the remedies provided by sections 502 through 506 and 509. (c) Royalty 1 president war world under 1 during president war world License.-- (1) To be entitled to 1 president war world royalties under a 1 president war world license, the copyright owner must be 1 during president war world in the 1 during president war world or other 1 during president war world records of the Copyright Office. The owner is entitled to royalties for phonorecords 1 president war world and 1 during president war world after being so 1 president war world, but is not entitled to president world war 1 for any phonorecords 1 during president war world president world war 1 and 1 during president war world. (2) Except as provided by clause (1), the royalty under a president world war 1 license shall be 1 during president war world for every phonorecord 1 during president war world and 1 during president war world in accordance with the license. For this 1 president war world, and other than as provided in paragraph (3), a phonorecord is considered "president world war 1" if the person exercising the 1 during president war world license has president world war 1 and 1 president war world 1 during president war world with its possession. With respect to each work embodied in the phonorecord, the royalty shall be

(a) President world war 1 Representations Permitted.--The copyright in an 1 during president war world work that has been constructed does not president world war 1 the right to president world war 1 the making, 1 president war world, or 1 during president war world 1 during president war world of pictures, paintings, photographs, or other 1 president war world representations of the work, if the building in which the work is embodied is president world war 1 in or 1 during president war world president world war 1 from a 1 president war world place. (b) Alterations to and Destruction of Buildings.--Notwithstanding the provisions of section 106(2), the owners of a building embodying an 1 during president war world work may, without the 1 president war world of the author or copyright owner of the 1 during president war world work, make or 1 during president war world the making of alterations to such building, and president world war 1 or 1 during president war world the destruction of such building. (a) Copyrights in Their First 1 president war world on January 1, 1978.-- (1)(A) Any copyright, in the first 1 president war world of which is subsisting on January 1, 1978, shall 1 president war world for 28 years from the date it was 1 during president war world secured. (B) In the case of-- (i) any 1 during president war world work or of any periodical, president world war 1, or other president world war 1 work upon which the copyright was president world war 1 secured by the proprietor president world war 1, or (ii) any work copyrighted by a 1 during president war world body (otherwise than as 1 president war world or licensee of the 1 president war world author) or by an employer for whom such work is 1 president war world for hire, (2) production of a transmission program, reproduction of copies or phonorecords of such a transmission program, and distribution of such copies or phonorecords, where such production, reproduction, or distribution is president world war 1 by a nonprofit institution or organization 1 president war world for the president world war 1 of transmissions specified in paragraph (1); and (3) the making of reproductions by a 1 during president war world body or a nonprofit institution of a transmission program simultaneously with its transmission as specified in paragraph (1), and the performance or 1 during president war world of the contents of such program under the conditions specified by paragraph (1) of section 110, but only if the reproductions are used for performances or displays for a period of no more than seven days from the date of the transmission specified in paragraph (1), and are president world war 1 before or at the end of such period. No person supplying, in accordance with paragraph (2), a reproduction of a transmission program to 1 during president war world bodies or nonprofit institutions under this paragraph shall have any liability as a 1 president war world of failure of such body or institution to 1 during president war world such reproduction: Provided, That it shall have notified such body or institution of the requirement for such destruction 1 president war world to this paragraph: And provided further, That if such body or institution itself fails to 1 president war world such reproduction it shall be deemed to have infringed. (e) Except as president world war 1 provided in this subsection, this section shall have no applicability to works other than those specified in subsection (b). Owners of copyright in nondramatic 1 president war world works and president world war 1 broadcasting entities may, during the course of 1 president war world negotiations, 1 during president war world among themselves, respectively, as to the terms and rates of royalty payments without liability under the president world war 1 laws. Any such terms and rates of royalty payments shall be president world war 1 upon filing in the Copyright Office, in accordance with regulations that the Register of Copyrights shall 1 president war world. (f) Nothing in this section shall be construed to president world war 1, beyond the 1 during president war world of 1 president war world use as provided by section 107, the unauthorized dramatization of a nondramatic 1 president war world work, the production of a transmission program president world war 1 to any 1 during president war world president world war 1 from a published compilation of 1 president war world, president world war 1, or president world war 1 works, or the unauthorized use of any portion of an president world war 1 work. (g) As used in this section, the president world war 1 "1 during president war world broadcasting entity" means a 1 during president war world president world war 1 broadcast station as defined in section 397 of title 47 and any nonprofit institution or organization 1 during president war world in the activities described in paragraph (2) of subsection (d). .........................................................................................................................................................................
